Luxe Den Holdings LLC provides:

• Lodging and geodesic dome glamping near Capitol Reef National Park, Utah
• Self check-in accommodations operated without on-site staff
• An email list for news and upcoming dates
• Travel guides and other informational content

Some amenities described on this website are planned rather than currently available. Availability of any particular accommodation or amenity is not promised by these Terms or by our marketing materials.

3. Email List

Joining our list requires only an email address. By joining, you agree that:

• You will provide an address you own or are authorized to use
• We may email you news, updates, and information about upcoming dates
• You may unsubscribe at any time using the link in any email
• Joining the list does not create a reservation or hold of any kind

We reserve the right to remove any address from our list at our discretion.

4. Reservations and Stays

Stays are not booked through this website. Where a reservation is made through another channel, the rates, deposit, cancellation and modification terms presented to you at the time of booking govern that reservation and control over these Terms to the extent they conflict.

Rates, dates, and availability described anywhere on this website are informational and subject to change.

5. Guest Responsibilities

House Rules

You agree to:

• Treat the property with care and respect
• Follow all posted house rules and instructions
• Not exceed the maximum occupancy for your accommodation
• Report any damage or maintenance issues promptly
• Leave the property in reasonable condition
• Comply with all applicable laws

Prohibited Activities

• Smoking inside any accommodation
• Pets, except where expressly permitted in writing
• Parties or events without prior written approval
• Subletting or unauthorized guests
• Commercial photography or filming without permission
• Any illegal activities

6. Property Damage

Guest Liability

You are responsible for any damage to the property caused by you, your guests, or your pets during your stay. We reserve the right to charge your payment method for repair or replacement costs.

Damage Assessment

• Minor accidental damage (spills, broken glassware) is generally covered
• Significant damage, intentional damage, or damage from prohibited activities will be charged to the guest
• We will provide documentation of any damage charges

7. Limitation of Liability

We are not liable for:

• Weather conditions affecting your stay
• Acts of nature, including wildfires, floods, earthquakes, or storms
• Utility interruptions beyond our control
• Personal injury or property loss unless caused by our gross negligence
• Third-party services or activities

Some jurisdictions do not allow limitation of liability for certain damages, so some of the above limitations may not apply to you.

8. Assumption of Risk

By staying with us, you acknowledge that:

• Outdoor activities (hiking, canyoneering, OHV and trail use, and similar) involve inherent risks
• The property sits in a remote high-desert environment at elevation, with unpaved roads and limited services nearby
• Wildlife may be present in the area
• Weather conditions can change rapidly
• The property is unstaffed, and assistance may not be immediately available on site

You voluntarily assume all risks associated with outdoor activities, use of the property and its amenities, and natural terrain and conditions.

9. Indemnification

You agree to indemnify, defend, and hold harmless Luxe Den Holdings LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your breach of these Terms
• Your use of the property or services
• Your violation of any law or third-party rights
• Any damage you cause to the property
• Any injury to persons caused by your actions or negligence

10. Intellectual Property

All content on our website, including text, images, logos, and design, is the property of Luxe Den Holdings LLC and protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

11. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

Informal Resolution

Before filing any formal claim, you agree to contact us at hello@luxedenresorts.com to attempt informal resolution. We will work with you in good faith to resolve disputes within 30 days.

Jurisdiction

Any legal action arising from these Terms must be brought in the state or federal courts located in Wayne County, Utah.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by:

• Posting updated Terms on our website
• Email notification to list subscribers
• Updating the "Last updated" date

Continued use of our services after changes constitutes acceptance of the modified Terms.

13. Severability
